However, the court disagreed, saying such changes do not automatically close criminal cases.Despite this, the court noted that the prosecution's only evidence was an affidavit referring to a complaint filed by the Building and Construction Authority (BCA), who failed to appear in court. No representative attended the sitting, nor were any supporting documents presented.Due to the lack of evidence behind the allegations, Magistrate Agius Bonnici found Umberto not guilty and acquitted her of all charges.The defence was led by Matthew Xuereb.
